Highly Skilled Migrant Programme
The Highly Skilled Migrant Programme, which initially commenced as a pilot scheme, has now been formally incorporated within the Immigration Rules. The requirements for the grant of further leave to remain and indefinite leave to remain in the United Kingdom under this category have been clarified. In order to initially qualify under this category an applicant must have sufficient points prior to lodging an application. If an applicant has remained in the United Kingdom in any other category he is allowed to aggregate that leave and therefore qualify for indefinite to remain after a 4-year period by accumulating the leave in the multiple categories.
Work Permit
Overseas Nationals may require permission to work in the United Kingdom. It is a criminal offence for a company to employ an individual who does not have the right to work in the United Kingdom. A UK based employer may employ an Overseas National under the Work Permit Scheme so long as they meet the required education and skills criteria. There are two categories under the Work Permit Scheme, Tier 1 and Tier 2. Under the Tier 1 category the Work Permit Application may be lodged for inter-company transfers, Board Level Position or equivalent, Inward Investment and to fill positions for shortage occupations. Tier 2 deals will all other types of applications, under this tier the employer must also prove that no other suitable resident worker is available to fill the position. From the 1st April 2003, Work Permits (UK) introduced a charge for the consideration of Work Permit Applications for Business and Commercial, Training & Work Experience, Sportspeople and Entertainers, Student Internships and GATS Work. The charge applies for the consideration of: initial Work Permit Applications:
- Initial Work Permit Applications;
- Extension Applications;
- Change of Employment Applications;
- Appeal Applications;
The charge is currently £95 for each application and this is due to be increased shortly.
There are certain categories of applicants who are exempt from the charge. Employers making applications to recruit Nationals of the Czeq Republic, Hungary, Slovakia, Bulgaria, Estonia, Lithuania, Romania, Slovenia, Poland, Cyprus, Malta, Latvia and Moldavia are exempt.
Sector Based Scheme
Under this category UK based employers may fill certain specified posts within the following sectors:
- Hospitality
- Food & Manufacturing
A 12 month visa is issued to anyone outside the European Economic Area (EEA), to fill a specified post under any of the above sectors. The category operates on a quota system.
