POINTS BASED SYSTEM
Following an extensive public consultation, a command paper entitled “A Points Based System: Making Migration Work for Britain” (CM6741) was published. This set out proposals to modernise and strengthen the UK’s immigration system by bringing in an Australian-style points system comprising five tiers:
• Tier 1: Highly skilled individuals to contribute to growth and productivity.
• Tier 2: Skilled workers with a job offer to fill gaps in the UK labour force.
• Tier 3: Low skilled workers to fulfill specific temporary labour shortages.
• Tier 4: Students
• Tier 5: Youth mobility and temporary workers: people coming to the UK to fulfill primarily non-economic objectives.
For each tier, applicants need to score enough points to gain entry clearance or leave to remain in the UK. Points are awarded based on objective and transparent criteria. The UK Border Agency will also look at whether the applicant is likely to comply with the immigration requirements in the UK.
The introduction of Tier 1 has resulted in the removal of the eight following immigration categories:
• Highly skilled migrant programme
• Investors
• Self-employed lawyers
• Business persons
• Writers, composers and artists
• International Graduate Scheme
• Innovators
• Fresh talent:: working in Scotland Scheme
The Highly Skilled Migrants - Tier 1 - embraces:
• General
For migrants who wish to find highly skilled employment in the UK.
• Entrepreneurs
For those investing in the UK by setting up or taking over and being actively involved in the running of a business.
• Investors
For high net worth individuals making a substantial financial investment in the United Kingdom.
• Post Study Work
This category aims to retain the most able international graduates who have studied in the UK. This element of Tier 1 will replace IGS, SEGS and FT and WISS.
Sponsorship – Tiers 2, 4 and 5
In all other cases, other than with regard to Tier 1 applications, an applicant wanting to come to or remain in the UK will require a sponsor.
In order to become a sponsor, the organisation will need to be licensed by the Border & Immigration Agency.
Tier 2 – Skilled Worker (general), intra- company transfers. Sports people and ministers of religion
Tier 4 – Student
Tier 5 – Temporary workers
